Once sold, plants or any other goods will not be taken back. After the plants or goods leave the seller’s nursery premises, the seller shall not be responsible for the health, drying, breakage, or damage of any plants, goods, or products. No replacement or refund shall be provided where a purchased plant, item, or product is damaged or dies after sale, subject to applicable law.

2. Seed Germination and Plant Gender

The seller does not guarantee the germination percentage of seeds or the number of male or female plants that may be produced from seeds. The gender of plants grown from seeds cannot be guaranteed.

3. Yield and Crop Performance

The yield figures shown in brochures or promotional materials are obtained under strictly controlled conditions. Actual yield, fruit colour, size, quality, and overall production may vary depending on soil conditions, local climate, water quality, fertigation, farming practices, and weather conditions.

4. Damage Due to Natural Causes

The seller shall not be responsible for plants drying out, becoming damaged, or failing to grow properly due to heavy rainfall, excessive heat, cold, inadequate water supply, temperature fluctuations, improper spraying, pest attacks, or other natural and environmental factors.

After plants have been taken from the nursery, the seller shall not be responsible for any disease, virus, or soil-borne pest that may affect them in the field, subject to applicable law.

5. Plant Inspection and Transportation

If transportation is arranged by the seller, the buyer must inspect the plants upon delivery to ensure they are in satisfactory condition. Any plants found to be unsatisfactory at the time of delivery must be reported and returned immediately, before the delivery vehicle leaves the farmer’s field. No complaints regarding the condition of the plants will be entertained after the seller’s delivery vehicle has left the delivery location, subject to applicable law.

If transportation is arranged by the buyer, responsibility for handling and transportation shall rest with the buyer once the plants leave the seller’s nursery premises.

Plant survival and growth after delivery depend on the buyer’s farming practices, handling, and prevailing weather conditions.

6. Factors Affecting Crop Quality and Production

The yield, colour, quality, size, and overall production of any crop depend on various factors, including local climate, soil conditions, water quality, fertigation, plant care, and weather conditions. The seller shall not be responsible for unsatisfactory crop results arising from these factors, subject to applicable law.

7. Plant Growth, Disease, and Pest Attacks

The seller shall not be responsible if plants dry out, fail to grow properly, or suffer damage due to heavy rainfall, insufficient or excessive water, temperature changes, improper chemical spraying, pest attacks, or other environmental and agricultural factors.

The seller shall also not be responsible for the failure of plants to achieve expected results due to local soil, weather, water conditions, or farming practices, even where guidance or advice has been provided, subject to applicable law.

8. Flower Drop, Fruit Development, and Plant Care

Flowers may fall from plants due to heavy rainfall, excessive or insufficient watering, temperature fluctuations, improper spraying, weather conditions, nutritional deficiencies, or other environmental factors. Such occurrences shall not automatically be considered defects in the plants.

Intercropping is not recommended where it may adversely affect crop growth or production.

Nutritional deficiencies and other growing conditions may cause fruits to vary in size. The seller does not guarantee uniform fruit size, colour, or production.

The seller does not guarantee complete immunity against viruses or other plant diseases. Even if a plant has some level of resistance, it may still become infected. The seller shall not be responsible for resulting losses, subject to applicable law.

9. Tissue Culture Plants

Tissue culture is a specialised plant propagation technology. Buyers are responsible for determining whether tissue culture plants are suitable for their agricultural requirements and growing conditions.

A virus-free certificate, where provided, indicates the plant’s virus-free status at the time of delivery. It does not guarantee that the plant will remain virus-free after planting in the field.

The tissue culture process may involve the use of chemicals and growth regulators. Variations in plant characteristics, yield, fruit colour, seed count, or other traits may occur. The seller shall not be responsible for such variations where they arise from the tissue culture process or subsequent growing conditions, subject to applicable law.

10. Payment Terms and Authorised Payment Methods

The seller shall not be responsible for cash payments made to its staff or dealers, or for funds transferred to their personal UPI accounts or personal bank accounts, unless otherwise required by applicable law.

All cheques must be issued as “A/C Payee” and made payable exclusively to “SHAYONA BIOTECH PVT LTD.”

Before making a UPI payment, buyers must verify that the recipient name displayed is “SHAYONA BIOTECH PVT LTD” and that the payment details are correct. Buyers are advised not to transfer funds to unauthorised personal accounts.

11. Cross-Pollination

Cross-pollination may occur naturally or artificially in all crops. The seller shall not be responsible for variations or losses in yield, quality, or plant characteristics arising from unwanted cross-pollination in the field, subject to applicable law.

12. Fruit, Flower, and Vegetable Development

The seller does not guarantee that every plant will produce fruit, flowers, or vegetables, or that the produce will attain a particular size, colour, shape, quality, or other characteristics. Such outcomes depend on various environmental, agricultural, and biological factors, subject to applicable law.

13. Buyer’s Responsibility for Plant Selection and Quantity

The seller does not compel any buyer to purchase a particular plant variety or a fixed quantity of plants or other goods. Buyers are free to select varieties and quantities according to their own requirements.

The seller does not prescribe the number of seeds to be sown or the number of plants to be planted in a particular area unless specifically agreed otherwise. Such decisions remain the buyer’s responsibility.

Good crop quality and yield require favourable climatic conditions, balanced fertigation, proper plant care, and other suitable agricultural practices. If any of these conditions are inadequate, crop results may be unsatisfactory in terms of quantity, quality, or both. The seller shall not be responsible for such results, subject to applicable law.

14. Limitation of Liability

To the extent permitted by applicable law, the seller shall not be liable for losses arising from plant damage, plant death, crop failure, variations in yield or quality, environmental conditions, farming practices, disease, pests, or other factors beyond the seller’s reasonable control.

Nothing in these Terms & Conditions shall exclude or limit any liability or consumer rights that cannot lawfully be excluded or limited under applicable law.
